Who we are
This website is run by Timothy Liam Alfred Shone (a sole proprietor), trading as Weaver, of 13 Jigger Avenue, Somerset West Mall Triangle, Somerset West, Cape Town. Email [email protected] or WhatsApp 066 328 0018. Our information officer is Timothy Liam Alfred Shone.
What these terms cover
These terms apply when you use this website and when you order from us. If you order a website, a care plan or email, our Website Services Agreement also applies. It has the full detail, we send it to you before you pay anything, and if it and these terms differ, the agreement applies.
Please read these points
They limit our responsibility or place responsibility on you, so we want you to see them before you buy:
- Our liability is limited. Our total liability is capped at the fees you paid us in the 3 months before the claim (or the build fee, for a claim about the build), and we are not liable for indirect losses such as lost profit or lost business.
- You are responsible for the content you give us: that it is true, that you have the right to use it (photos, logos, text), and that your prices, claims and specials are lawful.
- Changes you make yourself are your responsibility, including changes made by an AI assistant you use. We keep nightly backups (and, on care plans, restore points) so they can be undone; repairing them for you is paid work.
- Domain prices depend on the ending and are shown before you pay. The yearly renewal must be paid on time or the name can be lost.
- Plans have fair-use allowances. If your site keeps using more than its plan allows, we warn you first and, after notice, move you to a Boost (R149 a month) or a bigger plan.
- No website is ever 100% available or secure, and nobody can guarantee a Google ranking.
- Things outside our control, such as outages at our hosting provider, Cloudflare, Google, WhatsApp or a payment provider, are not our fault, though we will do what we reasonably can.
Nothing in these terms limits liability for gross negligence, fraud or wilful misconduct, or takes away any right you have under the Consumer Protection Act or other law that can’t be excluded.
Prices
All prices are in South African rand. We’re not VAT registered, so there’s no VAT on top. We may change the prices on this website, but the price in a quote you have accepted doesn’t change. Domain prices are shown before we register anything. Care-plan prices only change with 30 days’ written notice, and you may cancel instead.
Ordering and paying
- Website builds: 50% deposit before we start, and the balance before your site goes live on your own domain.
- Care plans, hosting, add-ons and email: paid monthly in advance from your launch day (or your start date for email only), by the 7th of each month.
- Domain names: invoiced when we register the name, then once a year, 30 days before it renews.
- How to pay: by card or Instant EFT through Payfast, or by bank transfer (EFT) to the account on your invoice.
Payment security: card and Instant EFT payments are processed on Payfast’s secure payment page. We never see or store your card details.
If you pay late: If an invoice is still unpaid 7 days after its due date, we remind you in writing and tell you the date your services will be paused. If it is still unpaid 7 days after that reminder (14 days after the due date), we pause your website, hosting and email until it is paid; paying switches them back on, usually within minutes. If it is still unpaid 21 days after the due date, we send a final written notice, and 7 days later (28 days after the due date) we take a final backup and close the service. We keep that backup for 60 days, and you can ask us for a copy in that time.
How we deliver
All our services are delivered online; there are no physical goods. A Starter website usually takes about two weeks and a Business website about three, counted from when we have your content. You see your site on a private preview address first, the build fee includes two rounds of changes, and it goes live on your domain once you have signed it off and the balance is paid.
Cancelling and refunds
See Cancellations and refunds for exactly what happens if you or we cancel. In short: care plans run month to month and end with 30 days’ notice; if you cancel a build before we start, you get your deposit back.
Your 7-day cooling-off right
If you are an individual (not a company or other organisation) and you order from us online, the Electronic Communications and Transactions Act lets you cancel within 7 days of ordering, without a reason or a penalty, and we refund what you paid within 30 days. This right doesn’t apply to services that, at your request, we started before the 7 days were up; our refund policy still applies to those.
Your responsibilities
Give us accurate information and content on time, check what we publish for you, keep your logins and two-factor codes secret, and handle your own customers’ personal information lawfully. Don’t use our hosting for anything unlawful, for bulk or unsolicited email, or for anything that attacks or overloads other systems.
Using this website
The information on this website is general and we try to keep it accurate and up to date; your quote and agreement are what count for your order. The text, design and logo of this website are ours. The photographs are free stock photos used under their licences; the example websites are labelled examples, not real businesses.
Referrals
If you share a referral link, our Referral terms apply.
Privacy
How we collect and use personal information is explained in our Privacy Policy.
Complaints and disputes
If something goes wrong, tell us in writing at [email protected]. We will reply within 2 business days and try to resolve it within 10 business days. If we can’t agree, either of us may suggest mediation before going to court. If you are a consumer, you may also contact the Consumer Goods and Services Ombud. South African law applies, and disputes go to the Magistrate’s Court.
Changes to these terms
We may update these terms. The date and version at the top show when they last changed, and changes don’t affect an order you have already placed.
